All site users are responsible for regularly reviewing these terms and conditions and additional terms posted in related areas. Use of this site and/or services constitutes your agreement to all such terms, conditions, and notices. If we decide to change our policies, we will post those changes, so our users are always aware of the rules for the site.

Web Site Monitoring:

Considering the real-time nature of this bulletin board system, it is impossible to review all messages as they are posted or to confirm the validity of anyone or the information that is posted. Any message posted expresses the view of the originating author. The owner of The Nagual Network may or may not agree nor concur with any message that is posted.

General Description:

This BBS is a collection of discussion forums where common sense tells us not to post any material which is knowingly hateful, harassing, threatening, invasive of another person's privacy. illegal, or inappropriate. Posting another person's private email or other private information on the BBS is considered invasive of their personal privacy and it will be edited and/or removed when it occurs.

Unregistered Names:

Bear in mind that any unregistered user name can be used and re-used by anyone at any time. Just because there are several messages posted by the same unregistered username, it does not mean that all of these messages were authored by the same person. That is, any unregistered name is available to any user of the site. For these reasons, users are strongly urged to register a username for use when authorship identification is important.

You, as a user of The Nagual Network site (including all domains pointing thereto), remain solely responsible for the content of your messages. Furthermore, you agree to indemnify and hold completely totally harmless the owners, administrators, developers, webmasters, moderators, and all related parties of The Nagual Network.

Personal Use Limitation:

Unless otherwise specified, The Nagual Network Sites and Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from The Nagual Network Sites and Services. Without the advance express written permission of The Nagual Network, you may not meta-search The Nagual Network Sites/Services, send, or cause to be sent, any automated queries of any sort to The Nagual Network Sites/Services, or use the Nagual Network Sites/Services in any commercial manner.

The Nagual Network Sites/Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, groups, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities designed to enable you to communicate with others (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and, when applicable, related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, YOU WILL NOT:

Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents to do the same.
Use any material or information, including images or photographs, which is made available through The Nagual Network Sites/Services in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
Upload files that contain viruses, Trojan horses, worms, time-based destructive programs, cancel-bots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another.
Use of meta tag searches on the web sites.
Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Restrict or inhibit any other user from using and enjoying the Communication Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
Harvest or otherwise collect information about others, including e-mail addresses.
Violate any applicable laws or regulations.
Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of an The Nagual Network Site/Service(s) or other user or usage information or any portion thereof.

Obligation:

The Nagual Network has no obligation to monitor the Communication Services. However, The Nagual Network reserves the right to review materials posted to a Communication Service and to remove any materials at its sole discretion. The Nagual Network reserves the right to terminate your access to any or all of the Communication Services at any time, without notice, for any reason whatsoever.

Information Collection:

The Nagual Network is the sole owner of the information collected on The Nagual Network, http://www.Nagual.com (and all domains pointing thereto). The Nagual Network collects information from our users at several different points on our Web site.

Information Use:

Information collected is used for site administration purposes only. Any personal information that is logged by or collected on the Nagual Net BBS, such as a user names, passwords, email addresses, URLs, IP addresses, and any other personal information, is kept strictly confidential and will not be revealed. Any such information will not be sold to any purchasing entity at any time.

Profile:

We store information that we collect through cookies, log files, clear gifs, and/or third parties to create a profile of our users. A profile is stored information that we keep on individual users that details their viewing preferences. Consequently, collected information is tied to the users personally identifiable information to provide offers and improve the content of the site for the user. This profile may be used to tailor a user’s visit to our Web site. We do not share your profile with other third parties.

Cookies:

A cookie is a piece of data stored on the user’s computer tied to information about the user. We may use both session ID cookies and persistent cookies. For the session ID cookie, once users close the browser, the cookie simply terminates. A persistent cookie is a small text file stored on the user’s hard drive for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. By setting a cookie on our site, users would not have to log in a password more than once, thereby saving time while on our site. If users reject the cookie, they may still use our site. The only drawback to this is that the user will be limited in some areas of our site.

Log Files:

Like most standard Web site servers we use log files. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. Information logged is not linked to personally identifiable information.

Service Announcements:

On rare occasions it is necessary to send out a strictly service related announcement. For instance, if our service is temporarily suspended for maintenance we might send users an email. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.

Legal Disclaimer:

Though we make every effort to preserve user privacy. However, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order, or legal process served on our Web site. The Nagual Network reserves the right at all times to disclose any information as The Nagual Network deems necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, at The Nagual Network's sole discretion.

Chat Rooms, Message Boards, and Public Forums:

Please keep in mind that whenever you voluntarily disclose personal information online - for example on message boards, through e-mail, or in chat areas - that information can be collected and used by others. In short, by posting personal information online that is publicly accessible, you may receive unsolicited messages from other parties in return. A general rule regarding the BBS and the Internet is always to be careful about what you reveal about your own personal self or life. Anyone may be surfing through here, so use discretion with anything personal you might reveal about yourself or anyone. Furthermore, do not take anything you read here for granted, too seriously, or as the absolute truth.

Changing, Deleting, or Deactivating Personal Information:

If a user’s personally identifiable information changes (such as zip code, phone, email or postal address), or if a user no longer desires our service, we provide a way to correct, update, or delete/deactivate users’ personally identifiable information. This can be done by sending an email to WebMaster@Nagual.com for the change request. Some functionality may be offered by the site tools, so please check your the "My Home" section after you have logged-in to use this functionality.

Materials Provided to The Nagual Network or Posted at Any Web Site of The Nagual Network:

The Nagual Network does not claim ownership of the materials you provide to The Nagual Network. Such materials may include any transfer of information, such as email feedback/suggestions, posting, uploading, or any other submittal to the site, (herein "Submission" and "Submissions").
